1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and Backyard Blueprints LLC, a Massachusetts partnership ("we," "us," or "our"). By downloading, installing, or using the Backyard Blueprints application ("App"), you agree to these Terms. If you do not agree, do not use the App.
2. What the App Does
Backyard Blueprints is a parametric 3D design tool for planning backyard sheds. It is intended for personal planning and visualization purposes only. The App is not a substitute for professional architectural, structural, or engineering review. Always consult a licensed professional before beginning construction.
3. License to Use
We grant you a limited, non-exclusive, non-transferable license to use the App on your personal devices for personal or commercial planning purposes. You may use and share shed designs you create with the App for any lawful purpose, including submitting them for permits or sharing with contractors.
You may not:
- Reverse engineer, decompile, or disassemble the App
- Redistribute or resell the App itself
- Use the App to build a competing product
4. Your Designs
You own the shed designs you create. We do not claim ownership over your design data.
5. Affiliate Links — Amazon, Home Depot, and Lowe's
Backyard Blueprints participates in affiliate programs with Amazon, The Home Depot, and Lowe's. When you click a materials link or use the "Build My Cart" feature, you may be directed to one of these retailers through an affiliate link. If you make a purchase, we may earn a commission at no additional cost to you.
Affiliate links do not influence our material recommendations. Prices and availability are set by the retailer and may change. We are not responsible for retailer pricing, shipping, or fulfillment.
6. No Engineering Warranty
THE APP GENERATES DESIGN VISUALIZATIONS FOR PLANNING PURPOSES ONLY. WE MAKE NO WARRANTY THAT ANY DESIGN PRODUCED BY THE APP IS STRUCTURALLY SOUND, COMPLIANT WITH LOCAL BUILDING CODES, OR FIT FOR ACTUAL CONSTRUCTION. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING THAT ANY STRUCTURE YOU BUILD MEETS ALL APPLICABLE CODES, PERMITS, AND SAFETY REQUIREMENTS.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKYARD BLUEPRINTS LLC AND ITS PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR PROPERTY, ARISING FROM YOUR USE OF THE APP OR ANY STRUCTURE BUILT USING IT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $10 IF YOU PAID NOTHING).
9. Indemnification
You agree to indemnify and hold harmless Backyard Blueprints LLC and its partners from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or any structure you build based on the App's output.
10. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above when changes are made. Material changes will be communicated via an in-app notification or an updated Store listing. Continued use of the App after the effective date of non-material changes constitutes acceptance of those changes.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction there.
